Terms of Use

This is the agreement between you and the developer of Pocket Garage. It is also the End User Licence Agreement (EULA) for the game. It is written to be read, not to be skipped — the parts about money are in section 5.

01The agreement

These Terms of Use (“Terms”) are a legal agreement between you and Gambit Global Ltd of Unit 501 Leroy House, 434-436 Essex Road, London N1 3FY, United Kingdom (“we”, “us”, “the developer”), covering the Pocket Garage mobile game and everything in it (“the Game”).

By downloading, installing or playing the Game you accept these Terms. If you do not accept them, do not use the Game — and if you have already installed it, delete it.

Our Privacy Policy explains how the Game handles data. It forms part of this agreement.

02Your licence

We grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and play one copy of the Game on any device that you own or control, for your own private, non-commercial entertainment, in accordance with the usage rules of the app store you obtained it from.

You are buying a licence, not the software. Pocket Garage is licensed to you, not sold to you. We keep every right we do not expressly grant here.

03What you may not do

You may not:

  • copy, sell, rent, lease, lend, redistribute or sublicense the Game;
  • reverse engineer, decompile or disassemble it, or try to derive its source code, except to the extent applicable law expressly permits despite this restriction;
  • modify the Game, or create derivative works from it, including modified builds and repackaged installers;
  • use cheats, automation software, modified game files, emulator manipulation or memory editors to alter gameplay, unlock content you have not earned or bought, or interfere with the advertising in the Game;
  • attempt to obtain rewarded-ad rewards without genuinely viewing the ad, or otherwise generate invalid ad traffic;
  • remove or obscure any copyright, trade mark or other proprietary notice;
  • use the Game in any way that breaks the law where you are.

Generating invalid ad traffic can cause an advertising account to be terminated by Google. That is a serious enough consequence to be worth stating plainly.

04Age

The Game is intended for players aged 13 and over [confirm against the age ratings actually submitted], and is not directed to children under 13. If you are under the age of majority where you live, you may only use the Game, and may only make a purchase, with the permission of a parent or guardian who agrees to these Terms on your behalf.

If you are a parent or guardian and a child has made a purchase without your permission, contact the app store you bought from — Apple and Google both operate refund processes for exactly this — and see our support page for the links.

05Purchases and Pocket Garage Pro

The Game is free to download and play. It offers optional in-app purchases, collectively called Pocket Garage Pro. Pro is sold in two forms, and it is important that you know which one you are buying.

5.1 What Pocket Garage Pro gives you

  • All advertising in the Game is removed — rewarded ads, the ad shown between sessions, and the sponsored panel in the garage.
  • All 26 cars are unlocked permanently, with no 24-hour rewarded-ad timers.
  • All paints, finishes, rims, tyres, spoilers, stripes, stickers and underglow colours are unlocked.

Pro does not add exclusive content that is unavailable to free players over time, and it does not affect vehicle performance.

5.2 Pocket Garage Pro Yearly — an auto-renewing subscription

Product identifier pocketgarage_pro_yearly.

  • Length of subscription: one year.
  • Price: the price shown in the store for your country, per year. The exact price, in your currency and including any tax, is always shown on the purchase screen inside the Game before you confirm, and again in the store's own confirmation dialog.
  • What it provides: the benefits listed in 5.1 above, for as long as the subscription is active.
  • Auto-renewal: the subscription renews automatically at the end of each yearly period, and your account is charged again, unless you cancel it at least 24 hours before the end of the current period.
  • When you are charged: payment is charged to your App Store or Google Play account at confirmation of purchase, and again at each renewal.
  • What happens when it ends: the Pro benefits stop at the end of the period you have paid for. Advertising returns, and cars unlocked only by Pro become locked again. Nothing you unlocked by other means is taken away, and no customisation you saved is deleted.
  • Free trial or introductory offer, if one is offered: any unused portion of a free trial period is forfeited when you buy a subscription, where the store's rules provide for this.
How to cancel

We cannot cancel your subscription for you. Subscriptions are managed entirely by the app store you bought from, and only you can cancel one. Step-by-step instructions for both stores are on our support page. In short: on iOS, open Settings → [your name] → Subscriptions; on Android, open the Play Store app, then Payments & subscriptions → Subscriptions.

Cancelling stops the next renewal. It does not refund the period you are currently in, and you keep Pro until that period ends.

5.4 Price changes

We may change the price of a subscription. Where we do, Apple and Google require that you are notified in advance and, depending on the size of the change and your region, that you actively consent before the new price takes effect. If you do not agree to a new price, cancel before the next renewal.

5.5 Restoring purchases

Because the Game has no accounts, your purchase lives with your store account. If you reinstall the Game or set up a new device, open Settings → Restore Purchases in the garage while signed in to the same App Store or Google Play account you bought with, and Pro will be reactivated. A purchase made on an Apple account cannot be restored on an Android device, or the other way round — that is a limitation of the app stores, not a choice of ours.

06Refunds

All purchases are made from Apple or Google, and all refunds are handled by Apple or Google. We are not the merchant of record, we do not process your payment, and we have no technical ability to issue a refund.

If a purchase failed, charged you twice, or did not unlock what it should have, write to us anyway. We cannot refund you, but we can look into whether something in the Game went wrong, and we can tell you what to say to the store.

Nothing in this section limits any refund right you have under mandatory consumer law — see section 19.

07Advertising

The free version of the Game is funded by advertising served through Google AdMob. By using the free version you accept that advertising will be shown. What data this involves, and how to make advertising non-personalised, is explained in the Privacy Policy.

Rewarded ads are always optional. You are never required to watch one, and declining an ad, or declining tracking, never reduces the reward you receive or restricts any part of the Game.

We do not control which advertisements are shown to you, and we do not endorse any advertiser or anything they offer. If you see an ad that is offensive, misleading or otherwise inappropriate, please tell us and report it using the AdChoices marker on the ad, so that it can be blocked.

08Progress and virtual items

Cars, paints, parts, in-game currency, unlocks and everything else you earn or buy inside the Game are licensed digital content, not property. They have no monetary value, cannot be exchanged for money, and cannot be sold, traded or transferred to another person.

Your progress is stored on your device and nowhere else. If you delete the Game, reset your device, or your device is lost or damaged, that progress is gone and we cannot recover it. Purchases are the exception — those can be restored, because the store remembers them.

09Availability, updates and planned features

We may update the Game, change how it works, add content or remove content at any time. Updates may be required for the Game to keep working.

The Game shows some modes — Track, Online AR and Online Track — marked “Coming Soon”. These are planned, not promised. They are not part of what you receive today, they are not part of what Pocket Garage Pro buys you, and we do not commit to a date or to delivering them at all. Do not buy Pro on the expectation of a feature that is not in the Game when you buy it.

We may stop distributing or supporting the Game. If we do, we will try to give reasonable notice through the store listing, and we will stop selling subscriptions before we do it.

10Intellectual property

The Game, its code, art, 3D models, user interface, sound, music, the name “Pocket Garage” and the Pocket Garage logo are owned by us or our licensors and are protected by copyright, trade mark and other laws.

Vehicle names and designs in the Game are original works or licensed assets. Any resemblance to real vehicles is stylistic. We do not claim any affiliation with, sponsorship by or endorsement from any real vehicle manufacturer, and any third-party trade mark that may appear is the property of its owner.

You may make screenshots and video recordings of your own gameplay and share them, including on monetised channels, provided you do not claim to be us, do not use our name or logo as your own branding, and do not distribute the Game's assets on their own. Third-party attributions are listed in the Game's credits.

11Third-party services

The Game includes software from Google (Google Mobile Ads, the User Messaging Platform, Firebase Analytics and Firebase Crashlytics), from RevenueCat, and the augmented-reality frameworks provided by Apple and Google. Your use of the Game is also subject to those companies' terms, and their handling of data is described in the Privacy Policy.

We are not responsible for third-party services being unavailable, and if one fails, parts of the Game — ads, purchase validation, AR — may not work until it recovers.

12Disclaimer of warranties

To the fullest extent permitted by law, the Game is provided “as is” and “as available”, without warranty of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment or non-infringement.

We do not warrant that the Game will be uninterrupted, error-free, free of harmful components, or compatible with every device, and we do not warrant that defects will be corrected.

Safety

AR mode asks you to move a phone around a real space while looking at a screen. Be aware of your surroundings. Do not use AR mode near traffic, near stairs, on a road, or anywhere a moment's inattention could hurt you or somebody else. Never use the Game while driving an actual vehicle. You are responsible for your own safety and for any damage or injury caused while using the Game.

13Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, or lost or corrupted game progress, arising out of or in connection with the Game, whether based in contract, tort (including negligence), strict liability or otherwise, and whether or not we were advised of the possibility.

Where liability cannot be excluded, our total aggregate liability to you for all claims arising out of or relating to the Game is limited to the greater of (a) the total amount you actually paid us for in-app purchases in the twelve months before the event giving rise to the claim, and (b) GBP 50.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded. Some jurisdictions do not allow certain exclusions or limitations, so parts of sections 12 and 13 may not apply to you, and in those places our liability is limited to the minimum extent the law permits.

14Indemnity

You agree to indemnify and hold us harmless from any claim, demand, loss or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Game, or your violation of any law or of the rights of a third party. This does not apply to consumers to the extent that mandatory law in your country says it cannot.

15Termination

You may end this agreement at any time by deleting the Game. If you have an active subscription, delete the Game and cancel the subscription in your store account — deleting the app alone does not stop the billing.

We may suspend or end your licence if you materially breach these Terms, for example by cheating or by generating invalid ad traffic. If we do, sections 10, 12, 13, 14, 17 and 20 survive.

16Changes to these terms

We may update these Terms. When we do, we will change the “last updated” date at the top of this page, and where the change is material we will give notice inside the Game or through the store listing before it takes effect. Continuing to use the Game after a change means you accept the updated Terms; if you do not accept them, stop using the Game and cancel any subscription.

17Governing law and disputes

The jurisdiction below has not been chosen yet. It should normally be the country where the developer is legally established, and it should be consistent with the address given in section 1 and with the trader details registered with Apple and Google.

These Terms are governed by the laws of England and Wales, without regard to its conflict-of-law rules. The courts of England and Wales have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Game.

If you are a consumer, this does not deprive you of the protection of the mandatory law of the country where you habitually reside, and you may bring proceedings in the courts of that country. Consumers in the EU may also use the European Commission's online dispute resolution platform.

We would much rather sort a problem out by email first. Please contact us before doing anything more formal.

18Terms that apply because of the app stores

18.1 If you obtained the Game from Apple's App Store

  • This agreement is between you and us only, and not with Apple. Apple is not responsible for the Game or its content.
  • Your licence is limited to using the Game on any Apple-branded product that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
  • Apple has no obligation whatsoever to provide maintenance or support for the Game.
  • If the Game fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation of any kind with respect to the Game.
  • We, not Apple, are responsible for addressing any claim by you or a third party relating to the Game, including product-liability claims, claims that the Game fails to conform to a legal or regulatory requirement, and claims under consumer-protection or similar legislation.
  • We, not Apple, are responsible for investigating, defending, settling and discharging any third-party claim that the Game infringes that party's intellectual property rights.
  • You represent that you are not located in a country subject to a US Government embargo or designated as “terrorist supporting”, and are not listed on any US Government list of prohibited or restricted parties.
  • Apple and Apple's subsidiaries are third-party beneficiaries of this agreement, and on your acceptance of it Apple will have the right (and will be deemed to have accepted the right) to enforce it against you as a third-party beneficiary.

18.2 If you obtained the Game from Google Play

This agreement is between you and us only, and not with Google. Your use of the Game is additionally subject to the Google Play Terms of Service. Google is not responsible for the Game and provides no warranty for it. Purchases and refunds are governed by Google Play's own terms.

19Consumer rights

If you are a consumer, you have statutory rights that these Terms cannot take away. In particular:

  • Digital content must be as described and of satisfactory quality. Where it is not, you may have a right to a repair, a replacement or a price reduction under the consumer law of your country.
  • EU/UK right of withdrawal. Consumers in the EU and UK normally have 14 days to withdraw from a distance contract. For digital content supplied immediately, this right is lost once supply begins with your express consent and your acknowledgement that you lose the right — which is what happens when you confirm an in-app purchase and the content unlocks straight away. Apple and Google present this at the point of sale on our behalf, and both operate refund processes that are often more generous than the law requires.
  • Nothing above affects your right to complain to a consumer authority in your country.

Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and us about the Game, and replace anything said before.

Severability. If any part of these Terms is held unenforceable, the rest stays in force and the unenforceable part is applied to the maximum extent permitted.

No waiver. If we do not enforce a right, that is not a waiver of it.

Assignment. You may not assign these Terms. We may assign them to a successor in connection with a sale of the business, on notice to you through the Game or the store listing.
